New ruling for DNA and "fake" DNA:
On June 13, 2013 the Untied States Supreme Court unanimously ruled that there can be no patent held on human genes that have been isolated and a patent can be a held on synthetic DNA (cDNA) as reported by The Science (1). Justice Clarence Thomas wrote “A naturally occurring DNA segment is a product of nature and not patent eligible merely because it has been isolated, but cDNA is patent eligible because it is not naturally occurring”.
The expensive test for the BRCA1 and BRCA2 genes, if positive it would show a disposition for breast cancer if the gene mutates. In a previous blog I wrote (3) about the move star, Angelina Jolie,
was tested positive for the genes connected to breast cancer and elected to have a double mastectomy. With this decision the Utah-based Myriad Genetics most likely will not be able to retain a patent on the BRCA1 and BRCA2 giving up a monopoly and most likely lowering the cost to be tested for the BRCA1 and BRCA2 without the lab having the fear of being sued for infringing on the patent.
However it will allow biotech companies like Monsanto to patent the cDNA or artificial DNA sequences. The billions of dollars of investment like the GMO (genetically modified organisms) and profit would be protected and yet what may be best for the country may not happen in the long run.

“How can molecular biologists synthesize DNA from RNA? In most cells RNA is synthesized from DNA. The different types of RNA are each used perform specific functions associated with protein synthesis. Placing functional genes from eukaryotes into prokaryotic cells requires creating DNA from mRNA that has had its introns excised. How do molecular biologists accomplish this? The enzyme reverse transcriptase is used. Reverse transcriptase is produced by certain types of viruses. The viruses contain RNA and create DNA that is used to produce more viruses. Reverse transcriptase’s unusual property of creating DNA from RNA has been exploited by biologists to create intron-free eukaryotic DNA for insertion into prokaryotic genomes.”
Final words:
Life complex and I think the companies who want to make money may depending on keeping things too complexes to figure out why they might not be so great and simplify the ideas any way they want.
The good part is nature can not be patented, however that means there is no protecting the natural from being invaded by a “fake” DNA (cDNA).
There is money to be made when something can be patented. If a company is only interested in profit they may be able to nicely package the information to “sell” what they want to their own benefit in the long run. It may leaves us all at the mercy of a giant biotech’s judgment who may make billions every year. The only way to change the direction of a company solely focused profit is not to purchase what they are offering. Then even if a cDNA is patented, offered for sale and not purchased than no company will most likely produce it in the future.
Once DNA has been changed there is a chance it will escape into nature and forever changing our world. It would be like opening a feather pillow to the wind and trying to collect each feather back no matter where it had landed. It is better to prevent a tragedy than to try to correct one.
Be more proactive we can all become just a little bit better and the more likely the negative results in life can be avoided. Stand up tall with an upright posture and be proactive.
